Minneapolis IRV Hearing Pushed Back

October 8, 2008 – Arguments on the lawsuit against the City of Minneapolis IRV voting system were pushed back today as the court used the allotted time to discuss evidentiary issues.

This day was intended to hear arguments for summary judgment of the issues relating to the constitutionality of instant runoff voting. But the plaintiffs submitted new affidavits as part of their response brief. The City of Minneapolis asked that the affidavits be disallowed, or at minimum, that Minneapolis and FairVote Minnesota have time to respond with their own affidavits.

The plaintiffs’ affidavits addressed the issue of “monotonicity” of voting systems.

Judge George McGunnigle issued an order later in the day that the affidavits will be allowed and has provided the defendants with an opportunity to respond, no later than November 6th. Click here to see Order.

The judge noted that the case had national implications and would likely rise to the appellate courts.
